ISLAMABAD: Shahbaz Gill, the PTI leader, was ordered to undergo another medical checkup by an Islamabad court on Friday because of his “poor health.”
The police requested an 8-day extension on his physical remand in a sedition case filed against him at the Kohsar Police Station due to anti-army statements made on television. The court later granted the ruling that had been reserved earlier today.
Shahbaz Gill should have another medical checkup because of his “poor health,” the court said, ordering administrators to hold him at the Pakistan Institute of Medical Science (PIMS) until Monday.
Judicial Magistrate Raja Farrukh Ali Khan rejected the defense’s argument that the two-day remand given on August 17 had ended and instead said that it had just begun. He also ordered the prosecution to present a medical report at the subsequent hearing.
Shahbaz Gill suffers from asthma, therefore please order testing, the court said.
The PTI leader was previously taken from the PIMS and brought before the court while wearing an oxygen mask.
“Gill became unwell following a court injunction”
During the hearing, Special Public Prosecutor Raja Rizwan Abbasi stated that a medical examination was carried out when Gill was admitted to the hospital to evaluate his health.
“Without a court order, the investigative officer may conduct a medical examination. Nowhere does it state that a suspect cannot be placed under physical remand if they are unwell “Abbasi disagreed.
The prosecutor said that when the suspect was brought to the prison he was OK and the medical report was normal, according to what the jail physicians informed the Islamabad High Court (IHC).
Abbasi claimed and asked for an extension in his remand that the doctor informed the IHC that Gill became unwell when the court approved his physical remand.
Gill’s attorney Faisal Chaudhry stated during his arguments that the medical report indicates his client was tortured.
“You have seen his health situation. This is a real problem, “added he.
He argued against the police’s request for an extension on remand and stated that this case was scheduled to appear before the IHC on Monday.
‘Healthy and fit’
The PTI leader was previously deemed “fit” and “healthy” and qualified for discharge at any time by a PIMS medical board.
The PTI leader had ten separate medical examinations and x-rays at the hospital, all of which were deemed “clear,” according to the article. According to sources, the study did not discover any signs of torture.
A district and sessions court ordered Gill, who had been imprisoned since August 9, to remain in police custody for an additional 48 hours on Wednesday. PTI, however, contested the situation before the Islamabad High Court.
The PTI leader’s condition apparently began to worsen when the court ordered the remand to be prolonged, and after an hours-long drama, he was transferred from Adiala Jail to PIMS.
IGP Islamabad is mandated to look into allegations of torture.
The IHC ordered the inspector general of police (IGP) Islamabad to submit a thorough report on Thursday about the alleged abuse of Gill while in police custody and the dispute at Adiala Jail regarding the accused’s custody.
The judge also gave Gill’s attorneys permission to see him in the hospital where he was receiving care.
After Gill’s attorneys claimed they had been prevented from contacting their client earlier on Thursday morning, IHC Acting Chief Justice Aamer Farooq presided over the hearing and permitted them to speak with him.
The Adiala Jail administration was given a show-cause notice by the judge for putting the man into custody past the stipulated time.
The IHC court denied the PTI attorneys’ motion to suspend the remand order and instead gave it until Monday along with an adjournment of the hearing.
Shahbaz Gill is deemed unwell by the Islamabad court, which demands a second medical test.
Shahbaz Gill’s remand received an 8-day extension requested by Islamabad Police.
